1. Scope and provider

These terms govern the purchase of a notabs software license from snekmedia GmbH, Paulustorgasse 8, 8010 Graz, Austria ("we", "us") via notabs.app. Deviating terms of the customer don't apply unless we agree to them in writing.

2. Product

notabs is an application for macOS 13 or later. You can use the full app free for 14 days. After that, a one-time paid license lets you keep using it. The license is perpetual and includes updates, as described on the website at the time of purchase.

3. Formation of contract

The product presentation on the website is an invitation to purchase, not a binding offer. By completing the checkout and clicking the payment button, you make a binding offer to buy. The contract is concluded when we confirm the order or deliver the license key by email.

4. Price and payment

The price is EUR 24, including any applicable VAT. The VAT rate follows your billing country; EU business customers with a valid VAT ID may be invoiced under the reverse-charge procedure. Payment is processed by the payment provider named at checkout, using the methods offered there. You receive a VAT invoice by email.

5. Delivery

Delivery is digital: after successful payment, your personal license key is sent to the email address used at checkout. The key is registered to that address; keep it safe. If it doesn't arrive, check your spam folder or write to office@snekmedia.com and we'll send it again.

6. License

Once paid in full, you receive a non-exclusive, non-transferable right to use notabs for your own purposes. You may not resell, sublicense or distribute the license key. The software is licensed, not sold; all intellectual property rights remain with us.

7. Right of withdrawal for consumers

If you are a consumer, you generally have the right to withdraw from this contract within 14 days without giving reasons.

Because notabs is digital content supplied without a physical medium, the right of withdrawal expires once performance has begun, provided you expressly agreed that we begin before the withdrawal period ends and acknowledged that you thereby lose your right of withdrawal (§18(1)(11) FAGG). You give this consent and acknowledgement at checkout. Until then, you can withdraw with a clear statement to office@snekmedia.com.

8. Warranty

The statutory warranty rights under Austrian law apply. We don't warrant that the software is free of errors or suits every purpose; the free trial lets you check that it suits yours before you buy.

9. Liability

We are liable without limitation for intent and gross negligence and under the Product Liability Act. For slight negligence we are liable only for breach of a material contractual obligation, limited to the foreseeable, typical damage. notabs closes windows the way their own close button does, so apps still ask to save unsaved changes. Your notes are local files you control; please back them up. Liability for lost data is excluded to the extent the law permits.

10. Applicable law and jurisdiction

Austrian law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. For consumers, the mandatory protective provisions of their country of residence remain unaffected. For businesses, the exclusive place of jurisdiction is the court competent for the registered seat of snekmedia GmbH.
